Appaloosa Management LP said it wants to enter into a confidentiality agreement with bankrupt car and truck parts maker Dana Corp. to determine whether its equity has value.
Currently the stock is valued at around 2$ a share.
Dana has denied Appaloosa's requests to enter into such an agreement though it has extended confidentiality to others as it begins to prepare a business plan, Appaloosa said. It holds 22.5 million shares, or 14.98 percent, of Dana stock and the majority of its Payables. Access to the non-public information would allow Appaloosa to determine whether Dana's equity will have value in the reorganization, it said in a filing with the U.S. Securities and Exchange Commission.
During private talks, Appaloosa representives told Dana top management that they are not welcomed to stay on board if the acquisition will succeed.
Appaloosa, a hedge fund headed by billionaire David Tepper, a company with just 16 people on the payroll, also is part of a group seeking a controlling stake in bankrupt auto parts maker Delphi Corp. The plan contemplated for the Delphi reorganization includes some equity recovery and a rights offering to current shareholders.
